There will be no apartments built on the old Kmart property in Neptune Beach.
An appeals court judge Monday upheld the Neptune Beach City Council’s denial of a zoning variance TriBridge Residential needed to develop a 175-unit apartment complex on the corner of Atlantic Boulevard and 3rd Street.
Mary Frosio is with the community group Neptune Strong, which opposed the apartment plan, known as 500 Atlantic.

“The city provided substantial evidence showing that the apartment complex would have an adverse effect on the community - the water, the sewer, the services, the police, the fire,” said Frosio.
Neptune Beach planners are in the process of reviewing and updating the city’s zoning codes.
In the meantime, Atlanta-based TriBridge has received permission from the Neptune Beach City Council to put a boutique hotel as well as shops and restaurants at the location.
WJCT news reached out to TriBridge for a comment but has not yet gotten a reply.
