On Tuesday’s show: Dogs, drugs and discerning between recreational and medicinal pot

A three-judge panel of the 5th District Court of Appeal decided last week that a police dog alerting to the presence of THC is not sufficient to justify a vehicle search, since the canine can’t differentiate between illegal pot and medicinal marijuana, or even legal and non-intoxicating hemp. The decision could make conducting probable cause searches or getting warrants more difficult for police. We discuss the implications of the 5th District’s decision (which encompasses Jacksonville) as well as possible workarounds for police going forward.
